The presidential veto is a highly noticeable and effective form of selected decision making. While personal uniqueness plays a role in presidential decision making, the veto decision appears mainly dependent on the individual bill, possibly because of the supremacy of congressional control over the substance of the legislation. Selected decision-making, while having a personal aspect appears less autonomous and more responsive to circumstances. Presidential signing statements are essential, if commonly obscure, tools of executive direct action. They can and have been used as an alternate to vetoes of legislation handed to the president for signature or veto but without the use of the recognized veto or the chance for legislative supersede processes. This form of veto has been used by the Bush administration very successfully.

The important rise in the number of constitutional opposition made by President Bush is compounded by the fact that these statements are symbolized by numerous objections, leading to over 700 challenges to separate provisions of law. The amount and scope of such contention in the George W. Bush Administration has led to wide-ranging debate over the issuance of signing statements, The American Bar Association (ABA) recently published a statement proclaiming that these tools are

“contrary to the rule of law and our constitutional separation of powers[and they] claim the authority or state the intention to disregard or decline to enforce all or part of a law…or to interpret such a law in a manner inconsistent with the clear intent of Congress.”
